Employment status disputes - substitution clauses

Archer-Hoblin Contractors Ltd v MacGettigan UKEAT/0037/09/ZT concerns the employment appeal tribunal's reversal of an earlier finding that an individual was a worker for the purposes of the Working Time Regulations 1998.

It was held that a clear and unambiguous substitution clause giving the individual an unqualifed right to delegate work was inconsistent with employed worker status.
