Budget – codification of concessions

The House of Lords' judgment in R (on application of Wilkinson) v HMRC [2005] UKHL 30, in denying the claim by a widower to the WBA which would be available to a widow, highlighted the limitations on the scope of the Revenue's discretionary powers when acting contrary to statute. The judgment cast doubt over the legitimacy of extra statutory concessions made by the Revenue.

These concessions are being reviewed and, where appropriate, will be legislated by Treasury order in the autumn.
